Why do I need a Cookie Consent Tool?

DSGVO, ePrivacy-VO and EU Cookie Directive

Almost every website uses cookies. These are needed to recognise users and to simplify their visit to the website. For example, the form fields do not have to be filled out again each time a visitor visits, or the access data are already held ready, or it is recognized what the visitor has already purchased.

The EU Cookie Directive

.

The legal handling is regulated in the EU by the so-called Cookie Directive. This EU Cookie Directive, which provides for an explicit consent of the user during the visit, was not implemented by Germany, however. Means: General EU directives are not equal to laws, but are to be implemented by the EU member states. This has not yet happened in Germany, so legally this cookie directive does not yet apply to us.

But it does.

Therefor there is the ? 15 Abs.3 of the Telemediengesetz (TMG). This states that it is sufficient to inform the visitor and point out a right of objection. This can be done in a notice in a banner with a link to the data protection declaration (regulation).

So, despite the EU Cookie Directive, current German law does not know any obligation to let users consent to the use of cookies.

To make matters really complicated: The EU Commission has stated that the Cookie Directive does not need to be implemented in Germany, as the current regulation already meets the requirements of the EU Cookie Directive.

This sounds strange.

This sounds strange, since the German rule does not require consent (i.e. confirmation with "Yes, I agree"), but only a reference to the right to object. Therefore, every website should offer a cookie notice so that there is no risk.

The GDPR

However, the DSGVO has been in effect since May 2018. Every website owner/operator who uses cookies must properly word their privacy statement since 2018. The GDPR requires that the legal basis for using cookies be explained in the privacy statement!

The GDPR does not explicitly regulate the default for "cookies". The ePrivacy Regulation should do that, but it is not yet in force. Website operators/owners can therefore currently only orient themselves on what the ECJ has currently decided in this regard and what the individual data protection authorities and the data protection conference stipulate. There are occasionally new rulings and requirements in this regard, which should be implemented as quickly as possible.

The ePrivacy Regulation was supposed to come into force at the same time as the DSGVO and regulate the areas of tracking and cookies. However, this has not happened to date. Current state: 2021

Is a cookie notice mandatory? What can I do as a website operator/owner?

The legally safest answer: cookie consent via Cookie Consent Tool!

Page operators should obtain consent for cookie use from visitors. The notice should definitely be displayed the first time the page is called up, before even one cookie is delivered. The text for the cookie consent must state as specifically as possible what data is involved, what it will be used for and to whom this data may be passed on!

The visitor must be informed in detail about the services (service providers) that set cookies and transfer data. He must explicitly confirm that he agrees to this.

And very important: Before the consent of the visitor may not yet transmit data, or the cookies are set!
